Samsung Display's OLED Patent Investigation by ITC Ends with No Violations Found

Recently, the U.S. International Trade Commission (ITC) concluded the Section 337 investigation initiated by Samsung Display Co., Ltd. regarding OLED patents. An ITC administrative judge ruled that there was no violation of Section 337 of the U.S. Tariff Act of 1930 in this case.

Samsung Display had filed the investigation in December 2022, targeting 17 mobile screen repair companies for allegedly infringing on OLED repair screen patents. They sought a general exclusion order, a limited exclusion order, and a cease-and-desist order. The ITC formally began the investigation in January 2023.

In February 2023, Chinese display panel manufacturer BOE Technology Group requested to intervene in the investigation, aiming to protect the healthy development of the display industry. This request was approved by an ITC administrative judge in March 2023.

Industry sources indicate that BOE and other domestic panel companies have collectively initiated an inter partes review (IPR) challenging the validity of the involved Samsung Display patents. Five cases have been successfully filed so far.
